FBPF partners Michael Farber and Thomas Papain, together with senior associate Diana Smithens, have achieved a total defense victory for a commercial moving and storage client in New York City commercial litigation before the New York City Civil Court. Facing multi-year litigation arising from a high-stakes operational dispute, FBPF secured a full discontinuance with prejudice, with zero financial contribution or settlement payout from the client.

Through a persistent commercial litigation defense strategy spanning over three years, the FBPF team aggressively pushed the matter toward dismissal through targeted discovery demands, rigorous compliance enforcement, and successive motions to dismiss. On the eve of a decision on FBPF’s motion to dismiss, the plaintiff agreed to surrender all claims.

FBPF negotiated a comprehensive stipulation of discontinuance with prejudice and mutual releases. To ensure absolute finality for the client, FBPF reinforced the agreement with protective covenants designed to bar any future attempts to re-agitate the dispute.

The result represents a complete defense victory in New York commercial litigation, allowing the client to walk away from the dispute without making any financial contribution or settlement payment.

Special recognition goes to FBPF paralegal Natalie Ferreira for her exceptional operational support throughout the litigation.
