PARTNER THOMAS PAPAIN SECURES SUMMARY JUDGMENT VICTORY IN BRONX COUNTY SUPREME COURT

FARBER BALSAM PAPAIN FERRARI partner Thomas Papain recently prevailed on a motion for summary judgment on liability on behalf of our client, an injured driver, in a case currently pending in Bronx County Supreme Court. We also successfully obtained a dismissal of Defendants’ affirmative defenses as to culpable conduct and failure to wear a seatbelt.

Our client was injured when a driver rear-ended him in Manhattan. Thomas Papain took the lead in preparing a comprehensive summary judgment motion, as well as an Affirmation in Reply in further support. Through these efforts, we were able to obtain a critical victory during this litigation. Winning summary judgment on liability means that there is no question of fact that the Defendants are liable for the injuries and damages caused to our client.
