Summary Judgment Win in Suffolk County Supreme Court

Partner Thomas Papain recently won a summary judgment motion on liability on behalf of our client, an injured driver in a rear-end collision case currently pending in Suffolk County Supreme Court (spouse has a claim for loss of society, services, and consortium). Thomas Papain also successfully obtained a dismissal of Defendants’ affirmative defenses, including culpable conduct and failure to wear a seatbelt.


Our client was injured when a driver rear-ended her. Thomas Papain took the lead in preparing a comprehensive summary judgment motion before any depositions were held. Through these efforts, he was able to obtain a critical victory for the clients early on in the litigation, just months after the lawsuit was commenced. Winning summary judgment on liability means that there is no question of fact that the Defendant is liable for the injuries and damages caused to our clients. Achieving a liability ruling in a client’s favor early on is an important win in a personal injury lawsuit because the focus then shifts solely to damages.
