New York Cannabis Proximity Law Update: What Retail Dispensaries Need to Know in 2026

Governor Kathy Hochul has signed new legislation (S9155/A10140) correcting prior school proximity review issues that impacted cannabis businesses across New York. This important update clarifies New York cannabis proximity requirements, protects certain licensees, and establishes consistent standards moving forward.


The legislation applies to Adult-Use retail dispensaries, CAURD licensees, microbusinesses with retail locations, and Registered Organization Dispensing (ROD) licensees regulated by the New York State Office of Cannabis Management. For cannabis operators, applicants, and investors, this correction provides regulatory certainty and reduces risk in the New York cannabis licensing process.


Background: The School Proximity Review Issue


In 2025, certain cannabis retail applicants were impacted by inconsistencies in how proximity to schools was evaluated. This created uncertainty for businesses that had already received written confirmation from OCM regarding location compliance.The newly signed legislation addresses these concerns and protects qualifying licensees and applicants from retroactive disruption.


Who Is Protected Under the New Law?


Existing Cannabis Retail Licensees


Cannabis retail businesses that received their license prior to February 11, 2026 are protected. These dispensaries may:


  • Continue operating at their approved location

  • Renew their cannabis retail license without relocation

  • Rely on prior proximity determinations


This provision ensures operational stability for existing New York dispensaries.


Pending Cannabis License Applicants


Applicants who previously received written confirmation from OCM that their proposed location complied with proximity standards may continue through the application process.

If approved, they may receive licensure at that confirmed location.


This protection is particularly important for CAURD applicants and microbusiness operators who made significant financial commitments based on prior regulatory guidance.


School Distance Requirement


Retail dispensaries must be located at least: 500 feet from the entrance of a school located on the same street.


House of Worship Distance Requirement


Retail dispensaries must be located at least: 200 feet from the entrance of a building on the same street that is exclusively used as a House of Worship.


The legislation also clarifies:


  • The methodology used to measure distance

  • What qualifies as an “exclusive-use” House of Worship


These clarifications are intended to prevent future inconsistencies in cannabis location approvals.

If a cannabis licensee or applicant seeks to change locations after February 11, 2026, the new site will be evaluated under the updated proximity standards.
